This Memorandum to File is intended as a public document to summarize the legal status of the closed session that was held with the City’s labor negotiators on October 2, 2023 as agenda item 14.1 to consider the Wages, Hours, Benefits, and Working Conditions of the MOU between the City and IAFF Local 2805. To protect a city’s bargaining position, such discussions are always held in closed sessions, which are specifically authorized by the Brown Act, and this session was held consistent with the Brown Act.
Of course, the discussions held during the closed session are confidential under the Brown Act. Consistent with that confidentiality requirement, I can state the following to memorialize what occurred:
First, there was no reportable action taken under the Brown Act.
Second, Staff was not given direction to seek to reopen the MOU with IAFF 2805.
Third, no action was taken with regard to staffing of any of the City’s fire stations. I understand that Staff will report to the Council on that subject in open session at a November meeting.
