Outdoor Dining Furniture Application

  1. Introduction
    The COVID-19 Pandemic has significantly stalled business development in Gilroy. Therefore, it is the desire of the City Council to support local restaurant businesses in creating new outdoor dining spaces, which are now critical to the success of restaurants and food service operations. For restaurant owners, the grant provides outdoor dining furniture, which would allow customers to patronize the business during the County’s current Health Order. For local governments, the potential benefit includes inducing municipal sales tax revenues, which are crucial for maintaining essential services such as police and fire, as well as other County and State emergency services. The aim of the Outdoor Dining Furniture Grant is to provide a mutually beneficial service to all economic stakeholders in the City of Gilroy’s commercial districts. By helping create a safe place to dine, while socially-distancing, there may be a moderate increase in economic synergy for commercial districts.
  2. Procedures
    Furniture will be distributed on a first-come-first-serve basis until assets are depleted, there are a total of 60 tables and 120 chairs available. It is expected that a restaurant will apply for an amount between one and four sets. Restaurants should expect the following order of events:
  3. 1. Restaurants will start by applying for the grant, opening July 8, 2020, at 8 am  
  4. 2. Within two business days, applicants may receive a grant reservation, if approved
  5. 3. Restaurants will then pick-up the reserved furniture from the City Annex at a mutually agreed upon time.
  6. 4. Restaurants will be required to assemble the furniture at their place of business.

  14. The applicant must acknowledge and agree to the following:
  15. Idemnity*
    The recipient shall commit to defend, indemnify and hold the City, including its elected officials, officers, employees and agents, free and harmless from any claims, liabilities, costs, penalties or interest arising out of any failure or alleged failure of the grant recipient or its contractors or consultants to comply with applicable laws.
  16. Operating Covenant*
    The recipient acknowledges that the assets remain property of the City of Gilroy and must be returned upon closing or relocation.
  17. Maintenance Covenant*
    The recipient shall agree to provide for ongoing maintenance of the property and, including, but not limited to, keeping the property free from litter, graffiti, peeling paint, unkempt landscape, and other unsightly features as determined by the City of Gilroy. Furniture shall be maintained in a safe and clean condition at all times. The recipient is liable for damage beyond normal and reasonable wear and tear. The recipient is required to ensure that the business is legal and compliant with the requirements of the zone applicable to the property. The recipient is required to maintain a clear pathway on sidewalks and all public permanent pedestrian facilities near their place of business (i.e. do not place furniture or signs on sidewalks).
  18. Nondiscrimination Covenants*
    The recipient shall not discriminate against person or group of persons on account of race, color, creed, religion, sex, marital status, handicap, national origin or ancestry in the sale, lease, sublease, transfer, use, occupancy, tenure or enjoyment of the site, nor shall the recipient or any person claiming under or through it or them establish or permit any such practice or practices of discrimination or segregation with reference to the selection, location, number, use or occupancy of tenants, lessees, subtenants, sublessees or vendees of the site.
